General Terms and Conditions of Trukar Sp. z o.o., ul. Białoruska 7/74, 30-638 Kraków, Poland, KRS 0001201266, NIP 6793345983 (hereinafter “Contractor” or “Trukar”), for contracts with its clients (hereinafter “Customer”).

01

Preamble

These terms apply to all orders for the acceptance and carriage of goods on behalf of the Customer. Customers may be businesses or consumers. Consumers separately confirm their acceptance of these terms when placing an order. Deviating or conflicting terms of the Customer do not become part of the contract, even if we do not expressly object to them.

02

§ 1 Placing an order and Customer information

  1. The Contractor is not obliged to accept orders received through the price calculator and need not give reasons. If there are doubts about the Customer’s ability to pay, the Contractor may require prepayment even after acceptance and set a deadline for it. It will inform the Customer by phone or in text form within 2 hours of accepting the order. If the Customer does not pay in time, the order is treated as cancelled by the Customer at short notice (§ 2 no. 8).
  2. The Customer submits the request via the price calculator on this website or by e-mail to dispatch@yourdomain.eu, stating the packages or load with length, width, height and weight, the contents and any dangerous-goods or temperature requirements completely and correctly.
  3. Goods must be stackable; otherwise the Customer must expressly say so. If the goods do not fit into the selected cargo space, the Contractor may terminate the contract for cause or adjust it. In case of adjustment, the rate is raised to the next level of the price calculator; the Contractor decides whether to use a larger or an additional vehicle and, where both are suitable, chooses the cheaper option. Claims for damages by the Customer are excluded in this respect to the extent permitted by law.
  4. The goods must allow load securing with straps; otherwise they may be refused.
  5. Household removal goods, works of art, unique items and valuables (in particular precious metals, gemstones, cash and securities) are excluded from carriage unless a separate contract with appropriate insurance is concluded in the individual case. § 6 also applies to removal goods.
  6. The Customer’s entries in the price calculator form the basis of the price and are binding on the Customer once the request is submitted. Additional costs such as customs duties, taxes, ferry or tunnel fees are charged to the Customer separately.
  7. Times shown in the price calculator are not guaranteed pick-up or delivery dates but a non-binding time frame. Binding time slots and fixed dates only arise from the Contractor’s express confirmation. All dates and transit times are subject to traffic, weather and other delays not caused by the Contractor.
  8. If the responsible person named by the Customer or another authorised contact cannot be reached within 2 hours of the first contact attempt despite several attempts, and the transport therefore cannot start or continue, the Contractor may terminate the order at the Customer’s expense and withdraw the vehicle.
  9. Vehicle types shown in the price calculator are rate levels that differentiate prices by weight and volume. There is no entitlement to a specific vehicle. The price covers only the packages stated in the order with dimensions and weight. If the declared load does not fit the selected rate, the Contractor may switch the order to the appropriate higher rate; if no higher rate exists, the maximum load volume of the selected rate is deemed ordered. Payload figures may vary by route.
03

§ 2 Offer, acceptance, prices and cancellation

  1. The Contractor generally responds to a binding request from the price calculator within 24 hours, confirming or rejecting it. Acceptance is made in text form (e.g. e-mail or WhatsApp).
  2. The loading area dimensions of a rate indicate the maximum space available. The Customer is entitled only to carriage of the packages actually booked.
  3. The Customer provides all transport documents in good time, at least 24 hours before the start of transport, and at least 48 hours in advance for cross-border transport with possible customs clearance. This expressly includes customs documents.
  4. Additional costs caused by missing documents or information are borne by the Customer, including the cost of any resulting extension of transit time not caused by the Contractor.
  5. The charge is the price calculated in the price calculator on this website and confirmed by the Contractor. Prices for businesses are exclusive of statutory VAT where applicable.
  6. If the Contractor uses third parties as carriers, it ensures that they comply with all legal requirements, in particular applicable minimum-wage rules. Its responsibility towards the Customer remains unaffected.
  7. Fixed dates and next-day deliveries require express confirmation and are charged separately.
  8. If the Customer cancels the order, 50 % of the agreed freight is payable for cancellation up to 48 hours before execution and 90 % for cancellation within 24 hours before execution. Third-party services already provided or started (e.g. customs clearance, ferries) and any waiting charges incurred are charged in full. The Customer may prove that the actual loss was lower.
04

§ 3 Performance of the order

  1. The Customer is entitled to a vehicle that is suitable and adequately sized for the load, not to a specific vehicle. The Contractor decides whether to use one vehicle or several smaller ones and, where both are suitable, chooses the cheaper option.
  2. Loading and unloading are not part of the freight order. The Customer is responsible for loading the goods safely for transport; the Contractor or the carrier it uses is responsible for loading in a manner safe for operation of the vehicle.
  3. Unloading is carried out by the consignee as the Customer’s agent; the Customer is liable for damage to goods or vehicle during unloading.
  4. The Customer notifies changes in weight or volume in text form at least 24 hours before the start of transport. If the transport can then no longer be carried out as offered, the Contractor decides whether to perform the order — if necessary with another vehicle and an adjusted price — or to terminate it. If notice is given less than 24 hours before the start of transport and the Contractor terminates, the Customer owes 50 % of the freight.
  5. If incorrect information from the Customer leads to overloading, the Contractor may terminate for cause. The Customer indemnifies the Contractor against all resulting costs, in particular fines, official confiscations, legal costs and reloading costs.
  6. Pick-up and delivery points must be accessible to standard-size trucks, including for loading and unloading (e.g. ramps, underground car parks). If not, the Contractor will ask the Customer to remedy this or name a suitable loading place; additional costs, waiting times and extra trips are borne by the Customer.
  7. The price includes loading and unloading time of 1 hour each for transports up to 150 km and 2 hours each for longer transports. Beyond that, waiting time is charged per hour or part thereof: EUR 30.00 for Caddy, van and curtain-side van, EUR 60.00 for trucks and refrigerated vehicles.
  8. If, in the event of an obstacle to delivery, the Customer does not give suitable instructions within 3 hours, the Contractor may terminate for cause and claim, in addition to the freight, the costs of return transport and any necessary storage. If the Customer does not collect the goods within 3 days, the Contractor may realise them in accordance with the law or dispose of them at the Customer’s expense; any proceeds are paid to the Customer after deduction of all expenses.
  9. The Customer ensures that a responsible person can be reached during transport and provides that person’s contact details if they cannot be reached via the company’s contact details.
  10. Vouchers apply only to the transport price including vehicle-related upgrades and cannot reduce the price below vehicle-related minimum prices. Waiting charges, cancellation fees and third-party costs (e.g. insurance, customs clearance, ferries, tunnels) remain unaffected.
05

§ 4 Payment and delivery

  1. Payment is made, at the Contractor’s choice, by prepayment or on invoice. Invoices are payable within 14 days without deduction. Unplanned public charges such as customs duties or import taxes are borne by the Customer and may be requested in advance. The Contractor is not liable for delays caused by late payment of such charges.
  2. With prepayment, fixed dates apply only if payment is received at least 24 hours, or for cross-border transport with possible customs clearance at least 48 hours, before pick-up. This also applies to customs costs.
  3. Delivery is made to the named consignee against signature. For consumers, delivery may also be made to a person who appears entitled to accept it (e.g. household members, persons authorised in writing, immediate neighbours); the Customer will be informed of the time and place of a delivery to a neighbour. Business customers must name an authorised recipient; otherwise the shipment is returned to the sender (§ 3 no. 8).
  4. If the Customer hands over the shipment with load carriers (e.g. pallets, mesh boxes), there is no obligation to exchange or return them unless separately agreed and paid for.
06

§ 5 Assignment, retention and set-off

Claims of the Customer against the Contractor may only be assigned to third parties with the Contractor’s prior written consent. The Customer may only set off against or withhold payment of the Contractor’s claims with undisputed, due or legally established claims. The Contractor has a lien and right of retention over goods in its possession for all claims arising from the contract.

07

§ 6 Special rules for removal goods

  1. These terms apply accordingly to removal goods unless otherwise provided below.
  2. Loading, unloading and securing the removal goods for transport are carried out solely by the Customer; the Contractor handles loading in a manner safe for operation of the vehicle. There is no entitlement to carry passengers.
  3. We offer and recommend special insurance for removal goods.
  4. The price includes a total waiting time of no more than 3 hours for loading and unloading. Beyond that, we charge per hour or part thereof EUR 30.00 for vans and small trucks and EUR 60.00 for large trucks.
08

§ 7 Liability

The Contractor is liable in accordance with mandatory statutory provisions, for cross-border road transport under the Convention on the Contract for the International Carriage of Goods by Road (CMR), and otherwise under the applicable national freight law. Liability for damage to goods is limited to 8.33 Special Drawing Rights per kilogram of gross weight unless mandatory law provides otherwise. These limitations do not apply in cases of intent or gross negligence or injury to life, body or health. We take out cargo insurance only on express instruction and for a separate fee.

Visible damage must be noted on the delivery note or CMR consignment note on delivery; non-visible damage must be reported in text form to dispatch@yourdomain.eu within 7 days of delivery.

09

§ 8 Final provisions

  1. The law of the Republic of Poland applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the CMR and mandatory consumer-protection rules of the country in which a consumer has their habitual residence remain unaffected.
  2. The place of performance and exclusive place of jurisdiction for all disputes with businesses and legal entities under public law is Kraków (Poland).
  3. Should any provision of these terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by a provision that comes closest to its economic purpose; the same applies to gaps in the contract.
  4. We process personal data in accordance with our Privacy Policy.
